§ 1 Scope, Customer Information, Consumer Information
§1.1 The following general terms and conditions govern the contractual relationship between |DSTRCT| e.U. as a commercial provider (see Imprint) and consumers/customers who purchase goods via the |DSTRCT| online shop and thus conclude a purchase contract, in the version valid at the time of the order.
§1.2 The terms and conditions can be accessed online at any time via our online shop. They are also offered in the footer during the purchase process and sent as an attachment in the order confirmation email.
§1.3 The contract language is exclusively German.
§1.4 By completing the order, the consumer accepts these terms and conditions without any restriction or reservation.
§ 2 Conclusion of Contract
§2.1 The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
§2.2 The consumer can place one or more goods in the shopping cart. During the ordering process, they enter their data and preferences regarding payment method, delivery options, etc. Only by clicking the "Pay Now" button does the consumer accept the offer to conclude a purchase contract.
§2.3 |DSTRCT| e.U. may accept the consumer’s offer by sending an electronic (email or SMS) order confirmation after receipt of the order. The purchase contract is concluded upon acceptance of the order.
§ 3 Correction Notice
Before submitting the binding order, the consumer can return to the page where their details were entered and correct input errors by pressing the "Back" button in their internet browser after reviewing their information, or cancel the order process by closing the browser. In addition, the consumer is informed of correction options during the ordering process.
§ 4 Storage of Order Data
The order with details of the concluded contract (e.g. type of product, price, etc.) is stored by |DSTRCT| e.U. In the order confirmation, the consumer has the option to view the order by clicking "View Order." For technical reasons, we recommend saving the product description, the terms and conditions, the return and cancellation policy, and order details for personal use (e.g. screenshot) or alternatively printing the entire page.
§ 5 Prices, Payment
§5.1 Unless otherwise agreed individually, the final prices apply plus any applicable delivery and shipping costs.
§5.2 You may pay by credit card, Klarna Sofort, Klarna invoice, PayPal, eps transfer, iDEAL, Bancontact, or alternatively via the express checkout button using ShopPay, ApplePay, or GooglePay. In any case, the purchase price must be paid within 7 days of the order confirmation. If the deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, the deadline ends on the next working day.
§ 6 Shipping, Shipping Costs
§6.1 Unless otherwise agreed individually, delivery is made by shipping to the delivery address provided by the customer.
§6.2 The amount of the applicable delivery and shipping costs is indicated within the online shop. If costs arise due to shipping abroad that exceed the usual shipping costs (e.g. customs duties and/or fees of any kind), these must be borne by the customer. If costs arise due to non-delivery (e.g. due to incorrectly provided shipping address) that exceed the usual shipping costs, these must be borne by the consumer. The right to refuse acceptance under the right of withdrawal is not affected.
§6.3 The shipping of goods purchased by the consumer usually takes place within the timeframes indicated under Shipping after order confirmation. These timeframes are indicative for the consumer. Should delivery delays occur, the consumer will be informed immediately in writing.
§ 7 Order Processing
Order processing and any communication usually take place via email. The consumer should therefore ensure that the email address provided is correct and that messages from |DSTRCT| can be received. This is not mandatory, however.
§ 8 Retention of Title
The goods remain our property until full payment has been made.
§ 9 Warranty
§9.1 Statutory warranty rights apply to our goods.
§9.2 If the goods are defective, |DSTRCT| e.U. is obliged, at the customer’s choice, to remedy the defect or deliver new, defect-free goods. |DSTRCT| e.U. is entitled to refuse the chosen type of remedy if it can only be carried out at disproportionate cost and if the other type of remedy would not entail significant disadvantages for the customer.
§9.3 The risk of accidental loss and accidental deterioration of the sold goods also passes to the buyer only upon handover of the goods, even in the case of a sale by dispatch.
§9.4 If the remedy fails, the customer is entitled, at their choice, to reduce the purchase price (reduction) or to withdraw from the contract.
§9.5 In the event of withdrawal from the contract, the customer is obliged to return the goods in full.
§9.6 Reduced items and SALE items are excluded from exchange.
§ 10 Copyright
§10.1 All contents of the website dstrct.eu – including but not limited to texts, images, layouts, design elements, illustrations, graphics, logos and other works – as well as all goods, works and products offered are subject to copyright.
Any unauthorized reproduction, editing, commercial use, distribution, inclusion in other works or publications, whether in print or electronic form, as well as any other further use, even in excerpts, is not permitted and constitutes a violation of copyright.
This applies in particular to:
- Copying or tracing designs and illustrations,
- Using product images or texts for commercial purposes,
- Uploading, sharing, or distributing our content on other websites or platforms without express consent,
- Any form of automated data collection (scraping) or reproduction of our product representations.
All rights reserved.
Any use or exploitation beyond the legally permissible limits requires the express written consent of the rights holder (DSTRCT e.U.).
Unauthorized use will be prosecuted under civil and criminal law if necessary.
§10.2 The maps are based on OpenStreetMap raw data. OpenStreetMap data are free data and are licensed under the Open Data Commons Open Database License (ODbL).
§ 11 Final Clause
If any of the above provisions are wholly or partially invalid due to statutory provisions, regulations, or changes in the law, all other provisions remain unaffected and continue to apply in full. In the event of the invalidity of an individual provision, the corresponding statutory regulation shall apply.
